La conducción compulsiva en el proceso penal
El trabajo de investigación se realizó con un triple propósito, primero; señalar la naturaleza
coercitiva de la conducción compulsiva; segundo, señalar los disímiles criterios adoptados por los
jueces, al momento de disponer la conducción compulsiva utilizando términos que son análogos a
una detención; y, tercero, señalar la importancia de la ejecución de la conducción compulsiva
para evitar la vulneración de los derechos fundamentales de la persona conducida.
El tipo de estudio es exploratorio descriptivo, con diseño no experimental transversal en el
enfoque mixto en la cual se hace uso del método de investigación argumentativo - interpretativo;
asimismo, la población está constituida por abogados especialistas en el nuevo proceso penal del
departamento de Lima, el método de determinación de la muestra es intencional no
probabilístico constituidos por magistrados, fiscales, abogados litigantes y funcionarios públicos
especialistas en el nuevo Código Procesal Penal, siendo la técnica de recolección de datos, una
entrevista con preguntas abiertas, que permiten al consultado poder brindar manifiestamente su
posición respecto a la conducción compulsiva.
Asimismo, se ha realizado análisis de otras fuentes documentales, los oficios del 2013 dispuestos
por diferentes órganos jurisdiccionales, que ordenan la conducción compulsiva; además, se ha
realizado un análisis de un caso del distrito judicial de Paseo sobre la problemática que presenta la
Policía Nacional de Perú al momento de ejecutar la conducción compulsiva.
Con dichos resultados, se concluye que la conducción compulsiva es una medida coercitiva de
carácter personal, la cual debe ser reglamentada para que su ejecución pueda establecer un
procedimiento especial - diferente a la detención - con la finalidad de no vulnerar los derechos
fundamentales de la persona que es conducida
Progress and Problems of Primary Education in Bangladesh: A Snapshot of 50 Years
Bangladesh is celebrating its golden jubilee of independence in 2021. This South Asian country has been struggling for ensuring equitable, compulsory, and free primary education since the British period. The main objective of this paper is to explore the progress and constraints of primary education in Bangladesh for the period of 1971 to 2020. This study was conducted following the documentary research method. The secondary data was collected from different personal and official documents. Following the data-driven thematic analysis, it is found that the number of schools, students, and teachers was expressively increased in the last 50 years in Bangladesh. The access of girls increased more than 20% and the ratio of female teachers boosted 58.2% in primary schools. Moreover, the enrollment rate amplified more than 45% where the dropout rate drastically decreased by 61% from 1976 to 2020. The education policies had some good suggestions for ensuring the progress of primary education, however, some of the recommendations have not been implemented yet. This study introduces a progress evaluation framework for analyzing the educational progress of developing countries in Asia and Africa
Picture This: Hudson's Bay Company Calendar Images and their Documentary Legacy, 1913-1970
Between 1913 and 1970, the Hudson's Bay Company (HBC) produced an annual calendar which it distributed free of charge through its department stores, fur trade posts, and various administrative offices. While quantities varied from year to year, on average the HBC sent out one hundred thousand of these calendars on an annual basis. Calendars, of course, are not unique to the Hudson's Bay Company. Mass-produced calendars first appeared in the United States in the middle part of the nineteenth century, and with advances in the printing trade and distribution networks, they quickly became popular tools in the advertising industry. Now catalogued in the Hudson's Bay Company Archives Documentary Art Collection, the Company calendar is a popular and often-used visual resource. This thesis undertakes an archival analysis of the HBC's calendars by examining the functional context of their creation. In recent years, archivists have been exploring various aspects of information about the provenance of archival records, since this information is essential to the records' care and use. Architectural modernism in Melilla: the genesis and development of a floral volumetric style
Estudio del proceso de construcción del inmueble ubicado en la calle López Moreno nº 2 -pleno ensanche y centro urbano-, cuyo proyecto inicial, elaborado por el ingeniero castrense Sr. Carcaño Más, así como suevolución y posterior transformación, bajo el diseño del arquitecto Sr. Nieto, nos lleva a formular, después de analizarlo estilísticamente, la aurora y el crepúsculo de una plástica modernista, floral y volumétrica, nunca, tal vez, tan plenamente orgánica y manifiesta, que parece concitarse, pretendida y forzada, en un mismo entorno y en idéntico espacio.This paper studies the construction of a building at no. 2, López Moreno Street, in the town centre. We offer a stylistic analysis of the original plan drawn up and implemented by the military engineer Carcaño Más andthe later changes introduced by the architect Nieto. This analysis suggests the origin and the conclusion of a modernistic floral and volumetric style, which is not seen so clearly nor so organically in other instances
The Fear of (One's Own ) History : on the relations beetween Medical Anthropology, Medicine and History
Even though for most of medical anthropologists, history of medicine is far from their professional interest, that is not the case in South European and specially in Latin American medical anthropology. For us, history of medicine is a seminal point of academic discussion in the last two decades particularly in those anthropologists who work on the processes of health/disease/care linked to medicalization. Among others interesting consequences, common areas of interest develop. This article aims to explore a main obstacle to the full conquest of interdisciplinarity, namely the persistence of subaltern discourses and practices related to medical history and to social sciences among the medical professions, which at the same time becomes also an artifact that led social scientists to misunderstand the image of medical history in medical practice
